Bains Barristers is committed to the principle of equal access to justice, to persons of limited means. As a result, an in-house committee considers on a case by case basis the eligibility of persons who apply to have us undertake their representation, when they are otherwise unable to afford quality legal services from a sophisticated criminal law firm.
Criteria to be considered include the means of the prospective client, the impact of a conviction on the applicant's life, and, most importantly, whether the applicant is in danger of suffering a miscarriage of justice if a compelling defence is not advanced.
Applications should be forwarded, preferably in writing, to Bains Barristers via fax or e-mail. If circumstances make it difficult to communicate other than by telephone (i.e. where the applicant is in custody), please still refer to the Bains Barristers Pro Bono Application Form to help guide discussions.
Bains Barristers applies the same criteria, whether or not the applicant has been approved by Legal Aid Ontario for funding. Our committee accepts a limited number of Pro Bono or Legal Aid files per year. The program is maintained as part of our commitment to the principles of Social Justice.
